TERMS OF SERVICE

These Terms of Service ("Terms") govern your access to and use of thefaithmade.com, the associated subdomains prayerguide.thefaithmade.com and emilyjohnsonblog.com, The Faith Made Bible App on the Apple App Store, and any purchase you make from Ben Facciani LLC, a Virginia limited liability company doing business as The Faith Made ("we," "us," "our," or the "Company"). By accessing or using any of the foregoing, you agree to be bound by these Terms.
1. Acceptance of Terms
These Terms are presented to you through conspicuous links in the footer of our website and app, rather than through a checkout agreement checkbox. Your continued use of our site, app, or services, or your placement of an order, constitutes your acceptance of these Terms in their current form.
2. Our Products and Services
We sell printed Bibles and companion study guides, a digital 365-day prayer guide, and a subscription-based iOS Bible app offering study content and audiobooks. We are the merchant of record for all products sold directly through thefaithmade.com and do not sell on behalf of third parties.
2.1 Amazon Listings
We also sell through Amazon under two listings: a seller-fulfilled (FBM) listing, ASIN B0HB3YG4SH, and a listing fulfilled by Amazon (FBA), ASIN B0HCMKHRHB. Orders placed through our FBA listing are fulfilled, and their returns and refunds are handled, entirely under Amazon's own policies rather than under our Refund & Return Policy; see that policy for details. We may operate additional Amazon listings in the future without amending these Terms.
3. Affiliates and Partners
We work with affiliate marketing partners, including AI Lab, who promote our products across Facebook, TikTok, and Instagram. Our affiliates are required to disclose their relationship with us by including the hashtag #faithmadepartner on qualifying posts. Affiliate links may direct you to our website or to one of our Amazon listings. We are not responsible for the content of independent affiliate posts beyond the disclosure requirement described above.
4. Eligibility
Our products and services are intended for adults aged 18 and over. Our site and app are not directed at children under the age of 13, and we do not knowingly collect personal information from children under 13.
5. Subscriptions
The Faith Made Bible App is offered on a subscription basis, billed through our website checkout, not through Apple In-App Purchase. Subscription billing, cancellation, and renewal terms are set out in our separate Subscription Terms, which are incorporated into these Terms by reference.
6. Intellectual Property; User Content
All content on our site and app, including text, product descriptions, images, and app content, is owned by us or our licensors and is protected by applicable intellectual property laws. You retain ownership of any reviews, testimonials, or other content you submit to us ("User Content"), but by submitting User Content you grant us a perpetual, royalty-free, transferable license to use, reproduce, and display that content for our marketing and operational purposes.
7. Account Termination
We reserve the right to terminate or refuse service to any customer, at our discretion, for reasons including suspected fraud, abuse of our return or refund programs, chargeback abuse, scraping or unauthorized resale of our content, or violation of these Terms or any policy referenced herein.
8. Disclaimer of Warranties; Limitation of Liability
Except as expressly stated in our Refund & Return Policy, our products are provided "as is" and we disclaim all implied warranties to the maximum extent permitted by law. To the fullest extent permitted by law, our total liability to you for any claim arising out of or relating to these Terms or your use of our products or services is limited to the amounts you paid to us in the 12 months preceding the claim.
9. Export Control; Restricted Parties
Our store ships worldwide. By placing an order, you represent that you are not located in a country or region subject to U.S. government sanctions or embargoes, and that you are not on any U.S. government list of prohibited or restricted parties. We reserve the right to refuse or cancel any order in furtherance of these restrictions.
10. Governing Law
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws principles, as Virginia is our state of formation and principal place of business.
11. Dispute Resolution; Binding Arbitration
11.1 Informal Resolution Required First
Before either party may commence arbitration or file an action in small claims court, the parties must engage in a mandatory informal dispute-resolution period of 60 days, beginning when one party provides the other with written notice of the dispute. This notice-and-cure period is a condition precedent to filing.
11.2 Binding Individual Arbitration
Except for claims that qualify for small claims court, any dispute arising out of or relating to these Terms, your purchase, or your use of our products or services shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall be seated in Virginia, with remote appearance permitted for consumers.
11.3 Class Action Waiver
You and we each agree that any arbitration or proceeding shall be conducted only on an individual basis and not in a class, consolidated, or representative action. If this class action waiver is found unenforceable as to a particular claim or request for relief, that claim or request must be severed and proceed in court, and all other claims remain subject to arbitration.
11.4 Mass Arbitration Provisions
Where 25 or more similar arbitration demands are filed by or on behalf of individual claimants represented by the same or coordinated counsel within a short period, the parties agree to the batching and bellwether procedures set out in our arbitration provisions then in effect, which are intended to manage mass-filing scenarios efficiently for all parties.
11.5 Small Claims Carve-Out
Either party may elect to bring a qualifying individual claim in small claims court in lieu of arbitration.
12. Changes to These Terms
We may update these Terms from time to time. Material changes will be reflected by updating the effective date at the top of this page. Your continued use of our site, app, or services after changes become effective constitutes acceptance of the revised Terms.
